Understanding statutory leave entitlements for employees in Namibia

Understanding employee leave entitlements is an important aspect of payroll and HR compliance. Employers operating in Namibia should ensure that leave is administered correctly and in accordance with statutory requirements.

1. Annual Leave

Employees are entitled to paid annual leave based on the average number of days in their ordinary workweek.

Per leave cycle, employees are entitled to at least four consecutive weeks of paid annual leave.

Examples include:

  • Employees working a 5-day workweek are entitled to 20 days of annual leave.
  • Employees working a 6-day workweek are entitled to 24 days of annual leave.

2. Sick Leave

Employees are entitled to paid sick leave over a 36-month sick leave cycle.

The entitlement is:

  • 30 days of sick leave for employees who work a 5-day week.
  • 36 days of sick leave for employees who work a 6-day week.

During the first year of employment, employees accrue sick leave at a rate of one day for every 26 days worked.

Per leave cycle, employees are entitled to at least four consecutive weeks of paid annual leave.

3. Maternity Leave

Female employees who have completed at least six months of service are entitled to 14 weeks of maternity leave.

Generally:

  • Four weeks are taken before the expected birth date.
  • Eight weeks are taken after childbirth.

Where there are medical complications related to the pregnancy or birth, maternity leave may be extended by one additional month.

Employees must provide:

  • A medical certificate confirming the expected date of confinement before commencing leave.
  • Confirmation of the actual return date following maternity leave.

The employee's basic salary is generally provided through social security, while the employer remains responsible for the balance of remuneration.

4. Compassionate Leave

Employees who have completed 12 months of continuous employment are entitled to five working days of compassionate leave with full pay.

This leave may be used when employees experience qualifying family circumstances requiring their absence from work.

5. Public Holidays

Namibia observes 12 paid public holidays each year.

Employees are entitled to payment for these statutory public holidays in accordance with applicable employment legislation.
