Employers must understand the statutory leave entitlements provided under Tanzanian labour legislation to ensure employees receive the leave they are entitled to while maintaining compliant payroll processes.
Below is an overview of the key statutory leave provisions employers should understand when employing staff in Tanzania.
Employees are entitled to 28 consecutive calendar days of paid annual leave for each leave cycle.
Unlike many jurisdictions, annual leave is not immediately forfeited if it is not taken. Unused leave may be carried forward for up to six months after the end of the applicable leave cycle. Only after this six-month period may the leave be forfeited if it remains untaken.
Annual leave generally cannot be paid out instead of being taken, except when employment terminates. Upon termination, any accrued but untaken annual leave must be compensated in accordance with the Employment and Labour Relations Act.
Employees are entitled to up to 126 days of sick leave during a 36-month cycle, provided the required medical evidence is submitted where applicable.
The statutory entitlement is divided into two payment periods:
Employers should ensure that sick leave records are maintained accurately, particularly where extended periods of absence occur.
Eligible employees are entitled to 84 consecutive days of paid maternity leave for each childbirth.
Where an employee gives birth to more than one child during the same birth, the entitlement increases to 100 consecutive days of paid maternity leave.
If the child dies within one year of birth, the employee is entitled to an additional 84 days of paid maternity leave within the applicable leave cycle.
The statutory entitlement is limited to four maternity leave events with the same employer.
Fathers are entitled to three days of paid paternity leave for each childbirth.
The leave must be taken within seven days of the child's birth.
Employees are entitled to four days of paid compassionate leave in qualifying circumstances.
Employers should ensure that internal leave policies clearly define the process for requesting and recording compassionate leave while remaining aligned with statutory requirements.
