Thailand
Work Permits & Visas
  • Foreign nationals must obtain a Non-Immigrant B visa and a work permit before commencing employment in Thailand.
  • The employer sponsors the application and must meet capitalisation and local employment thresholds.
  • Work permits are role- and employer-specific and must be amended if duties or location change.
Payroll
  • Employers must register with the Thai Revenue Department and the Social Security Office.
  • Payroll is typically processed monthly, with salaries paid at month-end.
  • Employers are responsible for withholding personal income tax and employee social security contributions and submitting monthly filings.
  • Annual tax reconciliation and income statements are required.
Employment Contracts
  • Contracts may be fixed-term or indefinite and should be in writing.
  • Probation Period: Commonly up to 119 days; longer probation periods may affect termination rights.
  • Working Hours: Standard working time is 8 hours per day and 48 hours per week. Certain roles are limited to 42 hours per week.
  • Overtime: Paid at 150% to 300% of the normal rate depending on timing and role.
  • Termination: Requires statutory notice or payment in lieu. Severance pay applies based on length of service, except in cases of serious misconduct. Collective labour relations are regulated but union coverage is limited in practice.
Employee Benefits
  • Social Security: Mandatory contributions apply.
    • Employer: 5% of salary (capped)
    • Employee: 5% of salary (capped)
  • Annual Leave: Minimum of 6 working days after one year of service, plus public holidays.
  • Sick Leave: Up to 30 paid sick days per year.
  • Maternity Leave: 98 days per pregnancy, with partial salary coverage through social security.
  • Paternity Leave: No statutory entitlement.
  • Other Benefits: Employers commonly provide medical insurance, allowances, and bonuses.
Tax Overview
  • Tax Residency: Individuals present in Thailand for 180 days or more in a calendar year are tax residents.
  • Residents: Taxed on Thailand-sourced income and foreign income remitted into Thailand.
  • Non-Residents: Taxed only on Thailand-sourced income.
  • Tax Year: January 1 – December 31.
  • System: Progressive personal income tax up to 35%.
